Terms of Service

1. Acceptance of Terms

By downloading, accessing, or using the ThriftWise App, you agree to be bound by these Terms of Service ("Terms"). If you do not agree with these Terms, please do not use the Services.

2. License and Use of the App

  • License Grant: We grant you a non-exclusive, non-transferable, revocable license to use the App solely for your personal, non-commercial purposes in accordance with these Terms.
  • Restrictions: You agree not to modify, reverse-engineer, or otherwise misuse the App or any part of it.

3. Description of Services

ThriftWise is an iOS application that allows you to capture and store photos, manage clothing item data, and save personal information (such as your email, age, and gender). The App utilizes functionalities such as camera and photo library access and interacts with remote data storage solutions (Supabase) and a photo and text analysis service (Gemini API provided by Google). The Gemini API is used solely for analysis purposes and does not store your data.

4. User Obligations and Prohibited Conduct

  • Accurate Information: You agree to provide accurate and current information when using the Services.
  • Prohibited Activities: You shall not use the App in any way that violates applicable laws or interferes with its proper functioning (including, without limitation, unauthorized access, data scraping, or distributing malware).

5. Intellectual Property

All content, trademarks, and intellectual property rights in the App and its content are owned by Wise Creations Inc. or its licensors. You may not use such content without express written permission from the rights holder.

6. Disclaimers and Limitation of Liability

Disclaimers:

  • The Services are provided "as is" and "as available" without warranties of any kind—either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
  • We do not warrant that the Services will be uninterrupted, error-free, or completely secure.

Limitation of Liability:

  • In no event shall Wise Creations Inc., its directors, employees, or affiliates be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of your use or inability to use the App.
  • This includes, without limitation, damages resulting from loss of data, loss of revenue, or any other financial losses—even if advised of the possibility of such damages.

Third-Party Services:

  • We are not liable for any acts or omissions of third-party providers, including Supabase or the Gemini API.
  • Gemini API, provided by Google, is used exclusively for photo and text analysis and does not store your data; our reliance on this service does not alter our liability limitations.

7. Indemnification

You agree to indemnify, defend, and hold harmless Wise Creations Inc. from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Services, or your violation of these Terms.

8. Modifications to the Terms

We reserve the right to modify or update these Terms at any time. Your continued use of the Services following any changes constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

9. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Wise Creations Inc. is incorporated, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Services shall be resolved through binding arbitration (or in the appropriate courts, if arbitration is not available) in the designated jurisdiction.
