Layers — Terms of Service

1. Acceptance of Terms

By downloading, accessing, or using the Layers app (“App”), operated by Wise Creations Inc. (“we”, “us”, or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree with these Terms, please do not use the Services.

2. License and Use of the App

  • License Grant: We grant you a non-exclusive, non-transferable, revocable license to use the App solely for your personal, non-commercial purposes in accordance with these Terms.
  • Restrictions: You agree not to modify, reverse-engineer, or otherwise misuse the App or any part of it.

3. Description of Services

Layers is a mobile application that lets you photograph and catalog your clothing, build and plan outfits, and receive AI-powered styling suggestions. The App uses camera and photo library access (with your permission), remote data storage (Convex), and an AI analysis service (Google’s Gemini API) to provide these features.

4. Subscriptions and Payments

  • Layers Plus: Certain features require a paid subscription (“Layers Plus”), billed through your Apple App Store account.
  • Auto-renewal: Subscriptions renew automatically at the end of each billing period unless cancelled at least 24 hours before the period ends. You can manage or cancel your subscription at any time in your App Store account settings.
  • Free trials: If a free trial is offered, any unused portion is forfeited when you purchase a subscription.
  • Refunds: Purchases are processed by Apple; refund requests are handled through Apple in accordance with App Store policies.

5. User Content

  • You retain ownership of the photos and content you add to the App. You grant us a limited license to store and process that content solely to provide the Services (for example, sending an image for AI analysis).
  • You agree not to upload content that is unlawful or infringes the rights of others.

6. User Obligations and Prohibited Conduct

  • You agree to provide accurate and current information when using the Services.
  • You shall not use the App in any way that violates applicable laws or interferes with its proper functioning (including, without limitation, unauthorized access, data scraping, or distributing malware).

7. Intellectual Property

All content, trademarks, and intellectual property rights in the App (excluding your user content) are owned by Wise Creations Inc. or its licensors. You may not use such content without express written permission from the rights holder.

8. AI Features Disclaimer

Styling suggestions and clothing analysis are generated by AI and provided for informational and entertainment purposes. They may be inaccurate or incomplete, and we make no warranties about their quality or suitability.

9. Disclaimers and Limitation of Liability

  • The Services are provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
  • We do not warrant that the Services will be uninterrupted, error-free, or completely secure.
  • In no event shall Wise Creations Inc., its directors, employees, or affiliates be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of your use or inability to use the App, including loss of data or revenue, even if advised of the possibility of such damages.
  • We are not liable for any acts or omissions of third-party providers, including Convex, Google’s Gemini API, RevenueCat, PostHog, or Sentry.

10. Indemnification

You agree to indemnify, defend, and hold harmless Wise Creations Inc. from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or connected with your use of the Services or your violation of these Terms.

11. Termination

We may suspend or terminate your access to the Services if you violate these Terms. You may stop using the Services and delete your account at any time.

12. Modifications to the Terms

We reserve the right to modify or update these Terms at any time. Continued use of the Services after changes constitutes acceptance of the revised Terms.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the jurisdiction in which Wise Creations Inc. is incorporated, without regard to conflict of law provisions. Disputes shall be resolved through binding arbitration or in the appropriate courts of that jurisdiction.
